The residence permit for an internship contract . We will analyze in detail what are all the requirements that you must meet.
What is the residency for professional internships?
This residence authorization gives the student the possibility to work legally in Spain with an internship contract or agreement , thus being able to legally reside in the country for the duration of said internships.
As it allows the student to modify his stay for studies to a residence card , extending his legal stay in the country automatically and without complex procedures.
That is, in this way you can start working in Spain without having to wait the 3 years required to get a regular work permit as a student.
Together with the job search permit , it is one of the most recommended ways to change from a student visa to a residence card.
In 2018, this authorization underwent important changes. One of the most important is that now you can apply directly from Spain, without having to apply for a visa in your country of origin (in the event that you are not yet in Spanish territory).
Who can apply for a residence permit for an internship?
This residence permit is designed for students who have completed level 6 or higher studies .
Any inferior training will not be accepted, and therefore the application would be denied.
In other words, we are talking about university studies, masters or doctorates ; but it also includes higher sports education, higher-level professional training, and higher artistic and plastic education.
More specifically, the student must have completed said studies within the last two years , although those who are still pursuing their degree may also request residency through an internship contract .
And we are talking about studies that can be both in Spain and outside of Spain .
That is, you can request this authorization whether you are studying in Spanish territory or if you are doing it or have done it in your country of origin.
In case of being within the Spanish territory, this student must have a study stay authorization at the time of application.
Main advantages
Like any residence under the law of entrepreneurs, this authorization has certain advantages that make it an ideal option . And these advantages apply to both the student and the hiring company.
First, it saves companies the need to navigate the long and tedious immigration procedures that any other work permit requires. Well, in this case it is not necessary to go to any office to start the process and present a long documentation.
Here everything is done electronically and in a much simpler way.
On the other hand, we are talking about much less binding and more flexible contracts , which means less resistance for the company.
That is, we can find short internship contracts (lasting 3 or 6 months), and not necessarily full-time.
As we have commented, the complete procedure is carried out electronically. This means streamlining the process on the one hand, but also greater efficiency and much faster response times on the other .
Internship contract
Through the internship contract there is a contractual relationship with the company or self-employed that hires the student , so the student is a worker of the same and contributes to social security.
These are contracts with a total maximum duration of 1 year , although it is usual to contract for 6 months (the minimum) and renew once this term ends.
At the salary level, you will not be able to earn less than the inter professional minimum for that particular position.
If the student becomes unemployed, he will be entitled to unemployment benefit.
Finally, note that it is possible to request this contract whether you have finished your studies in the last 2 years or if you are still studying them.
Internship agreement
On the other hand we find the way of the agreement. In this case, the student is NOT a company employee .
In other words, there is a relationship between three differentiated parties : the student, the academic institution in charge of internal management, and the company. That is why a direct employment relationship is not contemplated.
In this case, since the university or higher education center is in charge of issuing the agreement, the student must be studying at the time of application (the option of having already finished them would not be possible).
Requirements
We found a series of requirements that both the student and the company must meet in order to apply for this residence permit.
In the first place, the internships must be within the same scope as the higher studies completed , and at the same level of qualification. That is, the specific tasks and the position / functions of the student must go along the same lines.
On the other hand, the student must have private health insurance with the same coverage as the Spanish public health, without deficiencies or copayments. Its duration must be at least 1 year. You can find out more about the insurance requirements here .
As in any other residence authorization, we find the economic means . You must show that you have 100% of the IPREM . If you have an internship contract, you can use it as funds.
The company offering the internship must be up to date with payments with the Treasury and Social Security . She will be the one who initiates the request in the government delegation in which she is located or where her work activity is carried out.
At the documentation level, you must present the contract or internship agreement signed by all the parties involved. This in addition to the properly filled EX-04 model .
Finally, it is necessary to attach a document in which the company details the description of the internship program , its duration, conditions, who is the supervisor or instructor, hours of work, etc.
How long it takes?
As everything is done electronically, the process is much faster and more agile. The resolution time is 30 business days , and if after this period you do not receive a response, by positive silence the resolution is considered approved.
And the latter is totally beneficial.
The different government delegations tend to be quite slow in these procedures, so being able to resort to positive silence will be very useful, since you know that the maximum resolution time is always 30 days.
For how long is this authorization granted?
The time depends on whether we are talking about an agreement or an internship contract.
In the case of an internship agreement , the answer depends on the duration of the agreement. That is, the maximum is 6 months, but it may be less if the agreement so specifies . However, after these 6 months, it is possible to renew for an additional 6 months. At the end of that year, the employer must modify the general regime if it wants to continue to have the student-worker.
On the other hand, if it is carried out under an internship contract, the residence card has the same expiration period as the internship contract. In this case, the maximum is 2 years , without being able to be less than 6 months.
But keep one important thing in mind. The request is linked to the particular company . That is, if at the end of the 6 months of the contract you want to change company, you will have to make another request from 0, as the initial one does not work for you.
Modification of residence authorization for someone else
As we have mentioned, this authorization is a totally recommended route if you are a student and would like to live and work in Spain in the long term.
Well, if you follow the usual route, you will have to study for 3 full years in the national territory before being able to opt for a regular work permit.
However, if you use the path of residence authorization for internships, you will shorten the path enormously .
Well, once the validity of your internship or agreement ends, you can modify the residence authorization for someone else , a renewable work permit until you can achieve permanent residence in the country.
